A Different Take on Chief Justice Roberts Opinion

As many of us Conservatives fume over the Chief Justices' opinion, I would like to look at it in a different light and why I think this may be a Conservative Trojan Horse to torpedo the 16th amendment.

Justice Roberts opined that the Government has the ability to tax us, and it does under the 16th amendment. Without stating so, Roberts has brought to light the very danger that is the 16th. The amendments states:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

The dangers it represents are far reaching and limitless. Under this amendment the government can tax us 100% and we have no legal recourse. Roberts is stating this in his opinion but not directly. From a constitutional standpoint, he is spot on as much as we don't want to admit it. His opinion affirms the 16th and the power of congress to tax the daylights out of us as they see fit.
It seems to me that his opinion could be translated to " Hey, you want to be taxed, than so be it"

I believe his opinion will now open up the debate to repeal the 16th amendment because of the power it has to tax and destroy. Also another suit can be brought under the same pretense with a different twist: Yes it is a tax, but under the 10th amendment there is no enumerated power that the government has to tell us what to buy and not to buy. Then if this is upheld as 'yes the Gov does have the power under the Commerce Clause, then Insurance companies will only operate in the states and not the United States as a whole, getting the government out of our lives, and there is nothing they can do about it.

So, if there was ever a reason to repeal the 16th amendment, here it is!

Bobby Jindal Will Nullify Obamacare in Louisiana

Good thing Republican governors haven't settled on Michele Bachmann's advice of electing Romney and the world will be a happy place. Bachmann said the only way to kill Obamacare is to elect Romney, a man who pushed the bill on the state level as governor of Massachusetts.

Fortunately there is Scott Walker and Bobby Jindal who have taken the lead and announced they will do what the 10th Amendment gives them the power to do. Nullify Obamacare. (Michele Bachmann is establishment is really isn't very smart when it comes to all things Constitutional.)

Walker was the first governor to threaten nullification. Now Louisiana Governor Bobby Jindal is threatening nullification too.

"We're not going to start implementing Obamacare," Jindal said.


"Here in Louisiana we have not applied for the grants, we have not accepted many of these dollars, we're not implementing the exchanges," Jindal said. "We don't think it makes any sense to implement Obamacare in Louisiana. We're going to do what we can to fight it."

 Of course, Jindal only has this fight on his hands because Louisiana Senator Mary Landrieu sold out the state of Louisiana in what has become infamously known as the Louisiana Purchase, where she traded federal dollars for her vote.

John Brunner's Todd Akin and Sarah Steelman Commercial Outlines What is Wrong in the GOP

When they come home campaigning, the claim they are conservative champions. When they go off to Washington, well... That's a different story.

John Brunner's latest attack ad against Sarah Steelman and Todd Akin could be directed towards pretty much the entire Republican party these days. Not all of them, but most of them. Republicans have become big government spenders doing little to stop the runaway spending other than campaigning against it every two, four, or six years depending on the office they seek.



"When John Brunner was adding over 1,000 manufacturing jobs, politicians Todd Akin and Sarah Steelman were manufacturing debt.

"Akin voted four times to raise the debt ceiling, authorizing 3 trillion in new debt.

"Steelman voted to put Missouri billions in debt, and paid for it by permanently raising the gas tax.

"And both wasted millions on pork projects. More spending. More debt. Sound familiar?"



Of course, when it comes to Republican records, Republicans deny any wrong doing. More and more it's getting harder to differentiate the big government Republicans from the big government Democrats. They come back to our districts like Congressman Billy Long claiming he has a conservative voting record always shying away from why there was no significant spending cuts and reduction in the size and scope of government while trying to hide he voted for the largest single debt increase in our country's history and voted against your Constitutional rights again and again.

While Sarah Steelman thankfully has never reached the shores of Mordor on the Potomac, her record in Jefferson City is a deceiving resume that points once again Steelman doesn't have conservative values in her best interest.

Brunner's campaign commercial attacks Steelman and Akin, but it could damn well be used against most Republicans.

I just hope Mr. Brunner doesn't drink the Potomac Kool-Aid once we send him to Washington. With a month out from the Republican primary, John Brunner has a commanding lead over his decepticon rivals, and he appears to be attacking his rivals on all the right issues. I even heard he called out Akin on for voting twice on a bill that allows Obama to indefinitely detain Americans without due process.




John Brunner Launches Obamacare Attack Ad After SCOTUS Ruling



John Brunner, Republican for Missouri US Senate, launched a great campaign commercial about the reality of Obamacare and why we must send him to the United States Senate up until he says the word replace.

Why do Republicans feel they need to replace Obamacare? Why not just repeal it and get the federal government out of healthcare?

Thomas Jefferson, Independence Day, and Obamacare

This Wednesday, Americans will gather around their bar-b-ques, grill steaks and burgers, and prepare to shoot off fireworks. Like Christmas, most Americans probably won't think too much about the story that inspired their gathering. Rather, they will write it off as another paid day off to be fat, drunk, and happy. Get those Roman candles out.

I think this Fourth of July, days after the Supreme Court rules Obamacare lives, I want to reflect on the Declaration of Independence and Thomas Jefferson. For if it weren't for Jefferson's courage and the other 55 men who signed the Declaration of Independence to declare the crimes of King George against the colonies to justify their SECESSION (that is such a dirty word these days the left always try to connect to slavery) from England.

In that list of crimes Jefferson listed King George committed to justify secession, one stands out this morning.

He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our people and eat out their substance.


Doesn't this describe Obamacare? Obamacare grows government creating new bureaucracies (offices) that go as far as creating end of life counseling and national healthcare database that will hold information about you that should be protected by the Fourth Amendment. A government bureaucrat will have access to your health history and habits.

If you don't comply with the law, hither swarms of IRS agents will harass you and eat out your substance (your income) with penalties for non-compliance which Justice John Roberts simply called a tax to justify the entire bill.

Isn't it sad as we celebrate Independence Day how the crimes of King George resemble the crimes against our Constitution Obama, Congress, and now SCOTUS have allowed to threaten the very freedom this great document called the Declaration of Independence inspired to create through taking the first step of secession from England as war came to the colonies? Think about that as you light up your Roman candles this Fourth.


Constitution for Dummies Advocate Michele Bachmann Shows Lack of Constitutional Knowledge on Repealing Obamacare


Remember a couple years ago, Tea Party fraud Michele Bachmann wanted a Constitution for Dummies class for all new freshmen in the House of Representin'?  It turns out Bachmann is about as Constitutionally stupid as most of her colleagues. She was on the O'Reilly Factor Thursday night pushing Republican establishment talking points--elect Mitt Romney the inspiration of Obamacare and Obamacare dies.




"What Americans must realize is there’s one option left, just one option is the ballot box in November and I think more than ever Democrats and independents are going to be looking at a Mitt Romney for president. Because it’s a very clear contrast. It’s Barack Obama and you keep Obamacare or it’s Mitt Romney and you repeal it… And people should’t be fooled to think that we need to have 60 Republican seats in the senate. We don’t. We need fifty plus one. That’s all we need. That’s what the Democrats had wiht the reconciliation bill and we can repeal Obamacare. Don’t give up hope. We can get this done.”


Am I getting this right? The Tea Party darling Bachmann is looking to the Republican establishment as the only option left to repeal Obamacare--the same Republican establishment who came up with the mandate in the first place as an alternative to Hillarycare in 1994? Just elect Mitt Romney and all your worries will be over right Ms. Bachmann. Forget about the fact Romney ran his own miniature version of this horrendous law as governor of Massachusetts going even as far as funding Planned Parenthood while forcing Catholic Hospitals of Masschusetts to administer abortion pills.

This is a What Would Thomas Jefferson Do moment--not a What Would Michele Bachman Do moment.

Obviously ignoring what Scott Walker has already started in Wisconsin to using the 10th Amendment, Bachmann says we must trust the same Republicans who tell us year after year they are going to end the EPA, Department of Education, and overturn Roe V. Wade and never do must elect federal Republicans like herself in hopes they will actually follow through with one of these promises. I think that's a dangerous proposition.

So let's ask the question what would Thomas Jefferson do?



Nullify just like Scott Walker has started in Wisconsin.

“When the general government assumes undelegated power, its acts are, unauthoritative, void and of no force,” and Jefferson called nullification “the rightful remedy.”

Nullification is the legal right of a state invalidate any federal law it deems unconstitutional. This of course is part of the power of the 10th Amendment. One would think the Tea Party darling would know this, but she once again shows her ignorance by pushing the idea the federal government is once again the answer.

Scott Walker has already started the nullification process in Wisconsin.

Isn't it time to kick Michele Bachmann out of the Tea Party?

Transportation Bill Attacks RYO Cigarette Small Businesses: Billy Long's Vote Helps Close a Branson Business


John Cullen Hagerty won't be waving his American flag this Fourth of July. His American Dream just got regulated out of business thanks to an interesting provision in the new transportation bill Congress just passed today to be on the fast track to law going into effect on July 1, 2012.

Hagerty owns the Liberty Smoke Shop, Freedom Smoke Shop, and the Independence Smoke Shop in Branson, Missouri. Think of it as the Build-a-Bear for tobacco enthusiasts. Hagerty's customers buy various tobaccos and papers, void of all the addictive chemicals and preservatives big tobacco places in their cigarettes which have led big tobacco in court defending their products. Then his customers rent a high-speed rolling machine that makes their own custom cigarettes.


Consumers can roll 200 cigarettes for a fraction of what 200 Marlboros would cost, and his customers note the quality of the tobacco is much, much better.

It appears Big Tobacco and the fact roll your own cigarettes don't come with the federal taxes inspired enough members in Congress to sneak a provision in the transportation bill that makes the equipment Haggerty uses in his shop illegal to use under the legal conditions Hagerty has been using his machine. According to Hagerty, roll your own cigarettes is a lot like something I know a lot about, brew your own beer. You can escape paying federal taxes by rolling your own just like you can brewing your own beer and it's legal. This, combined with the fact Big Tobacco's lobbyists are very powerful in Washington, may be the driving reason Hagerty will closing his doors as these machines become illegal on July 1, 2012.

The Pittsburgh Post-Gazzette writes about the driving reasons Congress has targeted stores like Hagerty's.


Tobacco purveyors have a love-hate relationship with the high-speed, high-tech "roll-your-own" machines that allow customers to make cigarettes on the cheap. Those who operate them, and profit from them, love the machines. Those who don't say the machines might be illegal and are killing their tobacco businesses.

In the end, the government and the courts will decide whether these machines -- known as RYO filling machines -- represent a massive tax dodge or just a more efficient way to hand-roll cigarettes, something Americans have been doing for centuries.

"These places are manufacturing cigarettes," plain and simple, said Regan Bartley, co-owner of Smoker Friendly, a tobacco chain with stores in West Virginia, Ohio and Maryland. Her stores are in competition with tobacco shops, gas stations, convenience stores and other businesses that buy or lease the machines.

Here's the problem. Technically, Hagerty and other RYO stores have never sold a cigarette they have manufactured. They aren't in the manufacturing business. Like a Build-a-Bear store, users use the equipment to build their own cigarettes. Hagerty rents the roller to his customers.

Of course when you cut out the federal government from the slice of the pie, the federal government is going to find a way to bite back. This is just sad considering our Republic was founded on the ideas of limited government and fair taxation. We know tobacco has become a huge revenue source for the federal government and is taxed unfairly as Congress tries to regulate behavior.

Hagerty and his employees never operate the machines for the customers. They answer questions, but never perform any of the manufacturing steps. Yet the government is trying to call them a manufacture. This would be the same premise of renting a shovel from your local equipment rental store and then taxing the equipment rental store on the size of the hole dug by the person renting the equipment.

The federal Alcohol and Tobacco Tax and Trade Bureau says the roll-your-own machines take advantage of the "personal use" tobacco tax exemption so customers and stores can avoid paying cigarette excises.


Take advantage of the personal use tobacco tax exemption? So with unemployment rising and Obama, Democrats, and Republicans all touting the merits of small businesses in the American economy, we are going to put stores out of business and tax payers who work at these places in the unemployment line all because people have found a legal way not to pay taxes on something they enjoy?

Yes, especially when you look at the breakdown in Congress.

The House voted 373-52 in favor of the bill, which was supported by every voting Democrat, while 52 Republicans opposed it. In the Senate, the tally was 74-19, with 23 Republicans joining every Democrat in voting for the measure. Sen. Olympia Snowe (R-Maine) voted present, while Sen. Daniel Inouye (D-Hawaii) missed the vote.

Hagerty's own Congressman, Billy Long of Missouri's 7th District, who claims to be in staunch opposition to federal taxes and a friend to the small businessman voted in favor of the bill according to Congressman Long's Washington office, which I contacted this afternoon.

According to the Pittsburgh Post Gazzette, these machines may have the title "high speed" but on average it takes an hour to roll the equivalent of four cartons. This isn't an efficient process considering how little there is to an actual cigarette, but that's not going to stop Fedzilla from chomping down on the small businessman.

Hagerty is letting his customers know that because of this federal legislation, he is being forced to shut the doors on his three locations which create jobs in the Branson area. He is having five employees who will soon be on unemployment.

The Middletown Journal writes this is a joint effort between Republicans and Democrats to tax these small businesses.

In early March, Rep. Diane Black, R-Tenn., introduced House Resolution 4134, a bill amending the definition of a tobacco manufacturer to include “any person who for commercial purposes makes available for consumer use a machine capable of producing tobacco products.”


In addition, the Secure Rural Schools amendment sponsored by Sen. Max Baucus, D-Mont., and added to a U.S. Senate transportation bill would categorize retailers providing roll-your-own machines to customers as mainstream cigarette manufacturers for federal cigarette tax purposes.


Do these Republicans sound like they are small business friendly? Or are the fed by the big tobacco lobby who like the soft drink companies see consumers going to other products to fulfill their needs as these politicians see more revenue they can recklessly spend while threatening the livelihood of honest Americans trying to make a living in a tough economy? Once again, I ask is their really a difference between the two parties. They are fed by big corporations and always looking to feed on Americans by expanding the tax base. I don't see much difference between the two at all.

Hagerty says he can keep his shop open, but to maintain the costs of the federal stamps and the federal license required to produce cigarettes is so far out of reach for a store his size that he can't possibly afford to become a federally licensed manufacturer.

Once again, we see how government regulations kill the American dream. This time it's a Branson businessman who contributed to his country by creating jobs, contributing to the economy, paying federal income taxes, and collecting sales taxes for his community. Because he didn't pay a federal excise tax to his federal masters, Hagerty and so many RYO businesses like his have become victims of the federal leviathan.

In a sad goodbye to his customers, a veteran broke down in tears in Hagerty's store wondering what the hell is going on in the country he fought for that he can't buy a bag of tobacco and rent a machine to roll his own cigarettes. It really is a sad statement about our country, a country founded upon great wealth thanks to tobacco.

Port of Kimberling Boat Dock Fire, Kimberling City, Missouri



The main marina on the Kimberling City section of Table Rock Lake caught fire today. The owner of the Port of Kimberling Marina says they just stocked it for the upcoming holiday weekend with new skis and other boating supplies. Cause of the fire is unknown, but this could be an omen to the upcoming Fourth of July holiday considering the drought we now face.

The $64,000 GOP Obamacare Question: Politics or Constitution First?

Have you noticed the Republicans are cheering Justice John Robert's decision to uphold Obamacare? For Republicans, it's a free ticket to the White House as evident in Michele Bachmann's comments on the Bill O'Reilly show last night. Everywhere you look, Republicans seem jubilant this issue is going to lead to big wins in November.

I don't disagree.

 When I hear Congressmen like Billy Long of Missouri make the following statement in jubilation like he has just been delivered the Republican party's version of the Promised Land...

"You can't believe how many calls we're getting at our office. Everyone is furious about this, so it's going to be a big boon to us, as far as getting more members of the Republican party in the House, picking up the Senate in the Republican column and picking up the White House."


... I have to ask the obvious question. Will the Republican party put the Constitution before politics?

Apparently, the process in which Obamacare was passed didn't match the Constitutional workflow for a "tax". Remember, in Robert's decision, he said the law was legal because it amounts to a tax. For a tax to be Constitutionally legal, it must be introduced in the House of Representatives. Obamacare didn't follow this protocol and was introduced in the Senate. Therefore, Obamacare wasn't passed as a tax, which Obama even admits in an interview with George Stephanoupoulos that Obamacare was never a tax, which is why it went through the process it did. Remember the Senate was the easy part of the battle. The House is where the bill hit issues as Democrats had to bribe and strong arm their own members to get it passed.

So the question today is this. Will the Republican party establishment fight Obamacare before the November election citing this glitch in its procedure and put the Constitution first or will they put politics before the Constitution and start counting all the seats to be gained by allowing Obamacare to dig deeper into our society and fester with its infectious distaste for personal liberties.

My pick, based on little it appears Republicans care about civil liberties these days with their embrace of the Patriot Act and the NDAA with its indefinite detainment language, it will be full speed ahead with politics as usual rather than launching another Constitutional attack against Obamacare. For every day, this law survives, the harder it's going to be to reverse. You must remember this bill affects more than just healthcare and those changes are in process. Billy Long Failed Southwest Missouri on Defunding Obamacare

Article One Section Eight of the Constitution gives Congress the power of the purse. This was well known by Congressman Billy Long who ran for Congress promising voters he would defund Obamacare.

I can only find one instance where Billy Long and the Republicans attempted to defund Obamacare, and the provision they attempted to defund had nothing to do with the main basis of the legislation. The only instance of defunding Obamacare I can find on the Internet was legislation would repeal $100 million in funding for the construction of school-based health centers. Other than that I cannot find any instance of Billy Long and the Republicans attempting to defund Obamacare other than this school.

So what happened to Billy's big promises? If you remember in a video with Sarah Steelman, Long said his three top priorities were:

1. Defund Obamacare
2. Introduce a national version of the Missouri's Hancock Amendment
3. Term Limits






I can't find any piece of legislation or any evidence other than one vote where Congressman Long has actually attempted to defund Obamacare despite it being his number one priority?


Congressman Long, what happened to your priorities? 


Long has obviously failed to live up to his priorities, priorities that attracted that obviously voters embraced in the 2010 election. Yet, when you look at the bills Long has sponsored or co-sponsored, many of them increase the size of government or create new powers for the government like the federal broadband act he co-sponsored with Peter King. You may remember that because Long sponsored the bill no knowing it sold off HAM radio frequencies, the same HAM frequencies that were essential in saving lives in Joplin.





Co-sponsoring legislation to sell off HAM radio frequencies, in a bill you can tie to the Internet kill switch, was more important that drafting legislation to meet your number one priority.


Of course, when you look at Long's two other priorities, well, he appears to have quickly forgotten about those too. A national version of the Hancock Amendment may have also prevented this new tax known as Obamacare had it been in place. Of course, Billy Long's first piece of legislation was introducing a bill to have the federal government acknowledge National Auctioneer Day. Doesn't that really tell you where Billy's priorities are?





And that was followed by backing National Golf Day.





No bill to defund Obamacare though.






Is St. Louis, Missouri an October 2012 Target?

A St. Louis, Missouri Police Officer who noted the drills the Army is conducting in the St. Louis area says he has been told from higher ups to be prepared in October for an event.



Over the past few weeks, soldiers from Fort Mead have been training on the streets of St. Louis. They say they are normal training exercises to teach the National Guard how to use armored equipment, but this training could have been done at Fort Leonard Wood on federal military property--not on city streets.

So is something going to happen in St. Louis in August? Jim the St. Louis police officer does seem to have something heavy on his heart.

Reality Check: Hope the Obamacare Tax May be Invalid

You probably aren't going to see this on the cable Fox News station. It may be Justice John Roberts ruling is flat out wrong. Here's a Reality Check explaining the real problem ahead for Obamacare. The problem comes from the fact that if Obamacare is a tax, it didn't originate in the House of Representatives as required by the Constitution. Someone Justice John Robert's feeble mind overlooked this upon stating his opinion. There is hope this can still die.

Are You Ready for the IRS to Garnish Your Wages Over Healthcare?

If you think you hate the IRS today, just wait until Obamacare kicks in full swing in 2014. I don't think Americans quite know what hit them yesterday as Justice John Roberts used the power to tax to propose the idea that Obamacare is Constitutional.

Not only will the IRS have the ultimate power over your paycheck with the confiscation of your income through the federal income tax, they are going to oversee your healthcare.

One of my best friends and personal trainer Tom from Chicago introduced me to Dr. Joel Wallach a few years ago. Wallach is the nutritionalist that wrote "Dead Doctors Don't Lie". I have come to admire Wallach for his approach to nutrition as a healing agent. Wallach is now speaking up against Obamacare and specifically the Internal Revenue Service.

Here's why. If you fail to comply with Obamacare, that is if you refuse to allow the federal government to force you into a healthcare insurance contract, which they have no real Constitutional power to do, they are going to come after your paycheck and you won't have due process rights to fight it. They will take what they want when they want.



Garnishments will be the first attack on your freedom by the IRS when it comes to the new healthcare law. Get used to it because Obama has been growing the IRS seeing to it more funds are appropriated to the IRS so they can enforce this liberty killing bill.

Isn't it strange? Obama says he wants to ensure everyone has healthcare and yet he has positioned one of the most evil entities in the federal government that often causes stress induced health problems to enforce Obamacare.

In a comment to 97.9, Billy Long says the Obamacare ruling will be good for the Republican party.

I hate to burst Congressman Long's bubble, but for most of my life I have voted for the meaningless promises of the Republican party. Promises to protect life and reverse Roe V. Wade, promises to end the EPA, promises to end the Department of Education, promises to cut the size of government...

Every two years we hear these same promises, and yet no matter how many federal Republicans we elect, these promises become empty only to be made two years later.

Why should we trust Billy Long on this matter anyway. It was Billy Long who said there's lots of things about  Obamacare that are good, and he had to be coached in an interview with Sarah Steelman to oppose the mandate?

Electing Federal Republicans Won't Kill Obamacare

It's been nearly 24 hours since the Supreme Court issued its judgement that Obamacare is Constitutional. Strangely enough, I have seen plenty of evidence of the Republican party celebrating this judgement. As I have said in the past, there is power in Obamacare for the Republican party, and many believe Justice John Roberts handed Mitt Romney the White House yesterday. Pundits like Dick Morris didn't hide this belief. he came out and said it.

Heck, Congressman Billy Long in an interview yesterday came out and said it. Not seeming very concerned about the state of our Constitution, Congressman Long said Obamacare is about the best thing that could happen for the Republican party. Forget about the fact the federal government is going to force you into commerce while claiming you are a free people.

"You can't believe how many calls we're getting at our office.  Everyone is furious about this, so it's going to be a big boon to us, as far as getting more members of the Republican party in the House, picking up the Senate in the Republican column and picking up the White House."

That's right. Republicans are happy about the Supreme Court decision because they see it as the springboard to the White House and gain more seats in Congress. Game Over Obama! Mitt Romney is now the new federal master.

The talking points on the GOP are consistent. Elect federal Republicans and they will repeal and replace. Oh that word replace...

Replace refers to more central planning with the Republican brand on it, which means the Republicans will come up with a plan where there will be more federal control of your healthcare, just not as much as the Democrats want. We have to remember 1994, where Republicans were centrally planning an alternative to Hillarycare with the Heritage Foundation that created the basis of Obamacare with its government mandate that forces you to engage in commerce.

I hate to burst everyone's bubble here. Electing federal Republicans isn't going to kill Obamacare. I laugh listening to Mitt Romney on his pulpit preaching the religion of free market healthcare system when the system he ran in Massachusetts inspired Obamacare. That's already been said.

Federal Republicans have a long history of promising voters every two years they are going to end big, intrusive government whether it be the Environmental Protection Agency or the Department of Education. They make promises they are going to slay these beasts. You know what, Republicans continue to fund these bureaucracies year after year as they are in control of Congress.

Federal Republicans promise pro-life voters they are going to protect right to life. This one is not hard. Using their checks and balances all federal Republicans have to do is refute Roe V. Wade citing the Supreme Court has no Constitutional authority to rule on this matter and this is a states rights issue based on Federalist 45. Forty years of promises from federal republicans who take money from right to life groups year after year, and abortion is still the law of the land despite the Constitution giving the federal government no power to regulate life.

So I ask, as federal Republicans promote their talking points, all sounding the same with the words repeal and replace, based on federal Republicans promises of the past, why is this one different? Why do you trust federal Republicans won't be lured by the easy money of campaign donations by the powerful insurance lobbies who have a vested interest to see that Obamacare lives? Federal Republicans sell their souls everyday to lobbyists and special interests as they shelf their promises.

I know there is an increased enthusiasm to elect the liberal Republican Mitt Romney after yesterday. Romney is saying all the right words, which is predictable. I am amazed so many people are giving him a pass in these matters as he talks about all the bad things Obamacare is going to do while defending his healthcare plan in Massachusetts, which is virtually the same.

I say beware of federal Republicans. There are other ways to defeat Obamacare that are more sound that buying into meaningless promises they make every two years.

Remember, on the state and local level, we can work to nullify the law like Scott Walker is planning in Wisconsin. Putting your faith in the federal system is dangerous.

Mike Moon's Reaction to the Obamacare Ruling

Where does the answer to the question about the constitutionality of the Affordable (Health) Care Act (Obamacare) lie?  Is it with the “ever-benevolent”  federal government or does the responsibility for healthcare rest squarely on the shoulders of the patient and their physician?

In order to find the answer, we must consult the authority – the U.S. Constitution.
First, consider the Constitution’s Preamble: “We the people of the United States in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defence, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution of the United States of
  America.”

 “… Promote the general welfare…” is at the center of the debate.  The meaning at the time of the writing of the Constitution was health, happiness, or prosperity, not the giving of public or private assistance to the poor and needy.
The only way for the government to “care” for individuals is to take from one in order to give to another.  When a person takes from another without permission we call the act theft. In the case of the Affordable Care Act – is this not
theft? The Constitution, in Articles I, II, and III, clearly define the limits of power delegated to the government.  The word delegate is and important one.  An individual cannot delegate, or give, power they do not possess.  In my search, I found no authority given by the people of the U.S. to provide healthcare to another or to require anyone to purchase health insurance.

In  response to suggestions that a mandate to purchase healthcare insurance, A New  York Times article dated July 17, 2010, records President Barack Hussein Obama  words, “For  us to say that you’ve got to take a responsibility to get health insurance is  absolutely not a tax increase.”  

When pressed on the issue that the penalty appeared to fit the dictionary definition of a tax, Mr. Obama replied, “I absolutely reject that notion.”

Today,  the Supreme Court of the United States decided essentially that the individual mandate -- the requirement that most Americans buy health insurance or pay a fine -- is constitutional as  a tax.

So,  what is next?  Will future purchases require certain dimensions or colors? Will the Court or President follow the lead of New York Mayor Bloomberg in his battle against Coca-Cola and opine against Whoppers or Big Mac’s? We already have our own State of Missouri dictating how we feed our livestock.  

When will it end?  I say enough already!

History  is repeating itself. Remember how  the Declaration of Independence begins? “When in the course of human events it  becomes necessary for one people to dissolve the political bands which have connected them….”

Michael Savage Notes John Roberts Epilepsy Medicine Clouds His Judgement

Blame Obamacare on John Robert's epilepsy medicine. At least that's where Michael Savage points his fingers this evening on his radio show. Savage says, "Let's talk about Roberts. I'm going to tell you something that you're not going to hear anywhere else, that you must pay attention to. It's well known that Roberts, unfortunately for him, has suffered from epileptic seizures. Therefore he has been on medication. Therefore neurologists will tell you that medication used for seizure disorders, such as epilepsy, can introduce mental slowing, forgetfulness and other cognitive problems. And if you look at Roberts' writings you can the cognitive disassociation in what he is saying." Yeah, well I am not buying it. He had plenty of time to get this right, and he sided with the left. That is a mental illness not epilepsy Mr. Savage. I believe it is you that taught me that in the past.

Mitt Romney's Promise to Kill Obamacare is Empty


Under Governor Mitt Romney, Massachusetts residents were forced to pay fines to the state if they failed to purchase health insurance. Romney's healthcare bill in Massachusetts is identical to Obamacare in so many ways. So what is Romney doing today as news broke the Supreme Court declared Obamacare is Constituitonal under the 16th Amendment?

Why he is vowing to kill the bill he thought was a good idea when he was governor. He says it's the first thing he will do.

"This is a time of choice for the American people,” Mr. Romney said after the court ruling. “Our mission is clear. If we want to get rid of ‘Obamacare,’ we’re going to have to replace President Obama.”

So what am I missing here? Is it just the name Romney doesn't like? Is he upset Obama put his name in front of care rather than Romney who ran the pilot program in Massachusetts.

Romney says it will be the first thing he does when he is elected. The reality of that is much tougher than old Mitt wants to admit. First Mitt has to get to the White House, and it may not be as easy as it seems. This campaign is going to be nasty and Mitt Romney's liberal record.

It also is going to require something big to happen in the Senate. For Obamacare to be repealed it's going to take a lot more than electing Mitt Romney. The Republicans must get 60 votes in the Senate to repeal this. The likelihood of that doesn't look good.

My prediction: even if Mitt Romney wins, the likelihood of repealing Obamacare is slim. Today's decision by the Supreme Court was really the best way to kill Obamacare. Mitt Romney's campaign promises are promises he is going to have a hard time delivering. That's the reality of it.

Allen West and the Republicans Have Failed Us on Obamacare: Failed to Defund the Monster

Candidate Billy Long was confident on how to stop Obamacare. When I get to Congress I will work to make sure it doesn't get funded. 

This was heard from the mouths of many Republicans hoping to get to Congress or keep their seats in Congress. The idea was not to fund Obamacare immediately from the get go until a Republican president and a Republican Congress could ensure it's repeal. However, something didn't happen when these Republicans got to Congress.

The Tea  Party defections are starting to mount as it becomes clear that there is nothing  anyone can do to “fix” Washington. Representative Allen West who is widely admired and respected as a conservative leader in the Tea Party movement has  chosen to vote against a bill that withholds funding for ObamaCare saying that  he is saving his fire for greater battles ahead and that’s the problem. It seems  there is ALWAYS another fight down the road or around the corner that  conservatives promise to be all in for. Alas, all this does is keep the hope alive that electing more Republicans will get the good ship Tomorrow into the  port of Constitutional obedience.

Combine this with dozens of other “Tea Party” defections and then top off your “BackStabbers Delight” with Speaker John Boehner running the surrender flag up the ol’ lifting the debt ceiling flagpole and you have a recipe for frustration. What strikes me as even more galling is the lack of leadership when it comes to running the Congress as the Constitution demands. The Constitution gives Congress undeniable power to undo previous mischievous acts by simply not funding the transgression but on this sinking ship U.S Titanic there are no captains with the foghorns to do
that.

Following the news daily over the past year and a half since John Boehner took over as speaker, I can't recall one instance where Republicans made serious efforts to defund Obamacare. You can't really count this feeble attempt where Allen West voted against the bill as a serious attempt because in West's based on West's explanation, there  there were bigger fish to fry than defunding Obamacare. I remind you, all appropriations go through the house initially. So why is it key Republicans like Allen West voted against defunding Obamacare? 

I have speculated there is much power and money in Obamacare for both parties. The insurance companies get rich as mandatory coverage means less competition as you are forced to buy coverage, and I am sure there are lobbyists in DC tempting both Republicans and Democrats to make sure you swallow the fed's medicine. Of course these companies will write checks to campaigns just like the bailed out banks have. While Republicans say they are opposed to such things as bailouts, Mitt Romney's campaign had no problem taking $500,000 from the disgraceful Bank of America. Why should we expect this to be different when it comes to the insurance companies who know what is coming down the line--big profits from the federal mandate.

If Republicans wanted to slow down Obamacare, they would have immediately stopped funding. That hasn't happened. Instead they had a meaningless vote to repeal Obamacare they knew wouldn't pass in the Senate, and when they return from recess, Eric Cantor has promised a second vote. Like that's going to stop this monster now that Justice John Roberts has betrayed the Commerce Clause. Roberts isn't the only one to blame tonight. Blame also goes to the likes of people like Allen West.

TSA Screw With Captain Kirk: William Shatner Faces Airport Checkpoint Tyranny

I never saw Captain Kirk patted down to get on the USS Enterprise. Apparently celebrity status doesn't give you a pass from the TSA tyranny. William Shatner's been groped.

The Toronto Sun points out how Shatner was targeted by the TSA for the pat down.


Star Trek legend William Shatner was left nursing a bruised ego when his trousers fell down during an airport security check in front of dozens of fellow travellers.
The actor was queuing at Los Angeles International Airport to catch a flight to South Africa when he was singled out for a search by officials.
He had decided to wear loose-fitting clothing for the journey and did not have a belt holding his pants up - and he was left red-faced when they fell down, exposing his underwear.
Shatner says, "It was awful to have people looking at me with my pants down, probably the most embarrassing thing that's ever happened to me... It was a long flight so I wanted to wear loose clothing because I didn't want anything to bind me."
You know what this is don't you? This is a TSA thug all giggly and excited because he's about to frisk Captain Kirk. This is an abuse of power as you can bet it was his celebrity that earned him the pat down.

I highly doubt the TSA had any other reason to pat down Shatner.

Obama Disagrees with John Roberts Ruling on Obamacare

George W. Bush appointee Justice John Roberts declared today Obamacare is Constitutional because it's a tax. It appears Barack Obama himself might have some issues with Justice Roberts' legal opinion. Obama himself declared the mandate was never a tax.

In an interview with George Stephanoupoulos, Obama absolutely rejected the idea of the federal mandate being a tax.

STEPHANOPOULOS:  You were against the individual mandate…
OBAMA:  Yes.
STEPHANOPOULOS:  …during the campaign.  Under this mandate, the government is forcing people to spend money, fining you if you don’t. How is that not a tax?
OBAMA:  Well, hold on a second, George. Here — here’s what’s happening.  You and I are both paying $900, on average — our families — in higher premiums because of uncompensated care.  Now what I’ve said is that if you can’t afford health insurance, you certainly shouldn’t be punished for that.  That’s just piling on. Eric Cantor and Republicans Prepare for Obamacare Political Theater in the House with Second Repeal Vote

Eric Cantor is writing another meaningless script that will do little to end Obamacare. It is being reported Cantor scheduled a second repeal vote of Obamacare. Just more political theater that will do nothing while ignoring the fact the GOP wrote the federal mandate with the Heritage Foundation as an alternative to Hillarycare in 1994. They obviously aren't as opposed to it as they want you to believe. Just ask Congressman Billy Long who has come out in support of a couple of the mandates in Obamacare.



Cantor scheduled a vote to repeal Obamacare today as SCOTUS ruled it was constitutional as a tax. Of course, Republicans did this last year and of course it meant nothing. Pandering as usual, and I predict when push comes to shove as they promote Mitt Romney as their presidential candidate, the man who ran the pilot program for Obamacare in Massachusetts, the Republicans will soon grow to love the money and power that comes with Obamacare.

When it is is broken in ten years, Democrats will demand expansion of federal control over Obamacare through something even more tyrannical and it will be Republicans kicking and screaming they must save Obamacare just like they have with that other socialist medicine program called Medicare.




Romney Now Favors Obama's Illegal Alien Amnesty Executive Order Doubling Down on Amnesty

Mitt Romney now favors Obama's plan to keep 800,000 illegal aliens in the United States. With more Americans struggling to find jobs, Romney puts his stamp of approval on Obama's bypass of Congress and pandering to Latino voters.

A top Hispanic adviser to Mitt Romney’s campaign has said that the presumptive Republican nominee would keep in place President Barack Obama’s controversial order to halt the deportation of up to 800,000 young illegal immigrants.

Romney also doubled down saying he has own plan to give illegals amnesty.

‘Some people have asked if I will let stand the President's executive action,’ Romney said. ‘The answer is that I will put in place my own long-term solution that will replace and supersede the President's temporary measure.’


So with unemployment still skyrocketing in America, Romney will expand Obama's decision. That's just dumb!

Vicky Hartzler Denounces SCOTUS Obamacare Decision and then Promises More Federal Central Planning of Healthcare

Vicky Hartzler was quick to denounce the Supreme Court's decision today on Obamacare. then she turned around and promised more central planning from Washington of your healthcare.

“My House colleagues and I remain committed to repealing this troublesome law in its entirety,” added Hartzler. “This ruling highlights the critical need for a Congress and White House committed to refocusing attention on health care legislation that provides affordability, cost transparency, choice for senior citizens, and will protect the right of citizens to keep their current insurance policies.”
Oh yes, repeal and REPLACE because Republicans like Hartzler believe they are better central planners than the central planners that came up with this Obamacare legislation. Oh, that's right. Obamacare was inspired by...

 Republicans working with the Heritage Foundation in 1994 on an alternative to Hillarycare. Guess what, the federal mandate was part of this bill too. It would be nice if Republicans in Congress gave up this idea of central planning and just stuck with the limits of their jobs defined in Article One Section Eight of the Constitution. Republican central planning of healthcare really doesn't have a good record and has led to where we are now. Can we just drop the REPLACE part of repeal and replace?

Billy Long Denounces SCOTUS Obamacare Ruling, Then Promises More Central Planning of Your Healthcare

Billy Long was quick to denounce Obamacare despite claiming he likes a lot of the new healthcare law.



"This decision is not only a blow to Americans who must deal with the consequences of government takeover of health care, but it is also a blow to democracy and the individual liberties this country was founded on,” Long said in a statement after the ruling.“I will continue to fight in Congress to repeal this harmful law and replace it with patient-centered health care that addresses the rising cost of health care in this country.”


So what Billy Long is saying is we don't the SCOTUS ruling on Obamcare despite liking so much about Obamacare, but don't you worry, as a member of the federal government, he will repeal it and replace it with more central planning--central planning with the Republican brand that gives federal government more power over your healthcare, which they have no Constitutional power to perform.

 Why not just get the federal government out of healthcare Mr. Long? You do not have an enumerated power to regulate healthcare period. Drop the replace Mr. Long and just repeal.

Scott Walker Says Despite SCOTUS Ruling, No Obamacare in Wisconsin

Scott Walker has come out swinging after George W. Bush's Supreme Court appointment John Roberts ruled in favor of Obamacare as a tax and thus legal today. Walker says he will not allow the people of Wisconsin to be forced into contracts by the federal government, which is what Obamacare does by mandating you purchase healthcare insurance or be penalized by the IRS through taxes and other penalties.

Gov. Scott Walker says Wisconsin will not proceed with implementing the federal health care overhaul despite the U.S. Supreme Court upholding the central part of the federal law.
Walker said Thursday he would have preferred the court strike down the law, but he is holding out hope that a new president and Republican-controlled Congress will overturn it next year. In the meantime, Walker says the state will not proceed with setting up a health care exchange as is required.
Walker said the law will be a "massive tax increase on the people of Wisconsin and America."
He said the decision creates uncertainty for Wisconsin businesses and that's bad for job growth. Walker has also said businesses will be bullish about adding jobs since he won a June 5 recall election.
Unfortunately, Mitt Romney's Romneycare was the inspiration for Obamacare and was drawn up in 1994 as an alternative to Hillarycare by the GOP and the Heritage Foundation. I do hope other governors will stand up for their states rights and their citizens like Walker has.

Congressional Candidate Jason Green Reflects on SCOTUS Obamacare Ruling

Today is a very sad day, the Supreme Court decided that the largest tax increase and federal takeover in history is legal. It decided that the states are complete subjects to the federal government. It decided that other individuals have a right to your labor. It decided that the federal government can force you to buy a product, and if you don’t, you are subject to fines and/or criminal charges. I am obviously referring to the “ObamaCare” decision that was upheld today.

Regardless of such decision, healthcare in this nation will not improve. Costs will continue to rise, quality will continue to diminish, and innovation will decline. Our nation has had a recent history of centralized approaches to handle different concerns, if it be our monetary system, public education, or energy costs and access. How has such approach worked out for the examples referenced above? Centralized healthcare will be no different, as good intended policy will yield unintended consequences that reward corporate special interests and rob liberty from the individual.

The federal government has overstepped its authority for several decades now. The question becomes, what kind of individuals do we need to restore our constitutional liberty and cultivate an environment for job creation?

I believe its individuals who have an understanding of our constitution and of the market. I believe its individuals who are not afraid to challenge their party or the culture of Capitol Hill, in the name of liberty.

I ask you to take a stand with me, to take a stand against ObamaCare, against the Federal Reserve, against unconstitutional legislation such as the NDAA, and the departments of Commerce, Energy, Education, and the Transportation Security Administration.
I ask for your vote and support to shed light on all that is corrupt, and restore our nation’s constitutional promise!

George W. Bush's Supreme Court Pick Gives Obamacare New Life

We thought it was dead. There was no way the Supreme Court with a 5-4 conservative leaning majority would allow the federal government to force you into a contract.

Using the excuse of the power to tax, the Supreme Court basically concluded today Congress can pretty much make you do anything Congress wants you to under the guise of a tax including forcing you to purchase healthcare insurance.

 "The Affordable Care Act's requirement that certain individual's pay a financial penalty for not obtaining health insurance may reasonably be characterized as a tax... Because the Constitution permits such a tax, it is not our role to forbid it... The framers created a federal government of limited powers and assigned to this court the duty of enforcing those limits. The court does so today."  Justice Roberts ruled.

Who was the instrumental turncoat in this decision? Well it was George W. Bush's court appointment Judge John Roberts who joined the liberal leaning justices to give Obama his victory. For those who continue to argue Bush was conservative and a good president, well consider this just one more little present from the Bush administration, from the endless wars, to the expansion of federal healthcare under Medicare Part D, to the infringement of your rights through the Patriot Act, George W. Bush is the gift that keeps on giving to those who want the Constitution declared dead.

So there we have it. Once again betrayed by a Republican Supreme Court appointment. Obamacare will be the law of the land, and Justice Roberts pretty much ruled today Congress can do whatever it wants as long as it's called a tax. It's scary what this George W. Bush appointed justice ruled today.

What's scarier is in less than 18 months, the IRS will now be overseeing your healthcare.

Rand Paul Says Drone Lobbyists are Seducing Congress

Let's recall Dwight David Eisenhower's farewell address to the country. In it, Eisenhower the great Army general, warns the country of the vast military industrial complex and its threat to freedom. Eisenhower saw the writing on the wall where America would be launched into a state of perpetual war to keep the economy rolling through this manufacturing sector. Soon America would find itself in Vietnam with no intention to win--just a long drawn out war in which companies profited and young men died.

Here we are nearly 40 years removed from Vietnam and the war machine follows the same pattern--long endless wars. With nearly a trillion dollars a year in military spending, one would think we could crush Afghanistan, but that simply is not the case with the promise of more war on the horizon. What is the cost?

Well Americans are losing valuable liberties and freedoms in the name of national safety. In fact, Senator Lindsey Graham recently announced that our backyards are now the battlefield in the government's war on terror. Funny, the only thing I see as an enemy in my backyard are the Japanese beetles munching on my garden, none the less, the federal government is stepping up its campaign to use drones domestically.

Drones are the controversial remote control machines that are producing death to our supposed enemies. They are also full of error and are racking up the casualties associated with collateral damage. Now the federal government wants to fly them over the airspace in our cities and neighborhoods.

Senator Rand Paul has introduced legislation to stop these drones. It appears Congress will be bought by the drone lobbyists paid for by the same industrial military complex Ike warned of.

Paul recently appeared on the Jerry Doyle show talking about the influence and the power this drone army of lobbyists have in Washington:

PAUL: Interesting thing is, I went on CNN to announce this [drone legislation] the other day even before I went on CNN and I think even before I went on CNN — we didn’t think we’d announced it anywhere — we got a call before we went on to CNN from a lobbyist for the people who sell drones wanting to have a talk with us, somehow the word got out pretty quickly that we were going to be saying something about limiting what drones could do. People do make money selling stuff like this, you have to be aware that the advice they’re giving to congressmen is not particularly dispassionate that it has something to do making money selling this drone technology. And so we do have to be worried about it.
No regard for the Constitution. It's about the money, and you know Congress is going to fill their pockets before standing up for the Constitution with only a few exceptions, like Senator Paul and his father Ron Paul.

Obamacare Was Never About Healthcare: It's About More Taxes

In the end, the Supreme Court ruled came out and said what the Obamacare law is all about. It's not about improving your healthcare and lowering costs. It's about one thing pure and simple which is the reason it got through SCOTUS with a controversial decision that undermines the Commerce Clause. It's about taxation.

In the end, SCOTUS ruled Obamacare is nothing more than a tax, which is why it is legal--much like how Social Security was sold to the minions. One could see this coming based on the past.

It's the government's power to tax that keep Obamacare alive, and considering the IRS's part in the law, the writing was always on the wall. Washington will take more and grow more powerful with the SCOTUS decision and in a few years Obamacare will be broken. Democrats will claim they need to create a new nationalized healthcare system and Republicans will be dragged kicking and screaming "we must save Obamacare" just like they do with Social Security and Medicare. This is the reality of Obamacare. In the end, more will be taken from your shrinking paycheck.

The government can now force you into a contract and do it through new taxes. The friendly people at the IRS will show up at your door if you don't comply. Useless eaters will soon face the reality of death panels once you become too old to continue contributing to the federal tax base.

Welcome to the new America. I find it hard to celebrate July 4 and wave an American flag considering another tax is upon us and it was Jefferson who so brilliantly labeled the crimes of King George who taxed far less than what the federal government taxes today. Think about that as you shoot off fireworks next week.

Bow down to your federal master. They are now in more control of your healthcare and your wallet. Congress now, according to the Supreme Court, can do whatever it wants as long as they call it a "tax".

Missouri Governor Candidate Bill Randles Reacts to SCOTUS Obamacare Decision


The Supreme Court's Obamacare Decision: An Absurd Piece of Legal Theater

In a lengthy ruling today, the US Supreme Court used an avalanche of verbiage to obscure a dangerous outcome.  With the exception of one Medicaid provision, the High Court ultimately upheld the entirety of the Obamacare statute, including the individual mandate.  Though the Court found that the individual mandate failed under both the Commerce and Necessary and Proper Clause, it found it survived under the power to tax.  Though the Obama Administration consistently argued that it was not a tax, that gave no pause to the Court or the administration. 
This unprecedented extension of the federal tax power should frighten every American.  Under this reasoning, the federal government can use the power of a selective punitive tax to accomplish virtually any goal it wants.  In other words, it can pass unconstitutional requirements or restrictions on personal behavior and so long as it enforces it as a tax on those who do not comply this Court will uphold it.  Since this Court allows punishment of citizens who do not buy a product, this Court has now elevated the power to punitively and selectively tax above other explicit limitations on federal power.  Where would this stop?  A punitive tax on printing presses of newspapers who do not comply with federal rules?  A punitive tax on churches whose teachings do not comply with administration preferences?  Once the Court elevates the power to tax above the explicit limitations of federal power and the Constitution, it renders those limitations virtually meaningless. 
This opinion finding this ground to uphold an unconstitutional statute may be deemed clever by the left, but is extraordinarily dangerous.  From here on, you will see extensions of federal power couched in taxation terms.  History will regard this opinion as a low point for the Supreme Court.  The consequences of this ill-advised opinion will come home to roost shortly.
To conservatives this opinion should reinforce two key convictions.  First, elections matter.  We must replace the President with someone who will appeal Obamacare and appoint Supreme Court justices with a realistic view of the Constitution.  We must also now elect governors who will redouble their efforts to stand against federal overreach – especially since the Supreme Court has made clear it will be of no help in resisting unconstitutional laws.  Second, this opinion illustrates the desperate need to eliminate the income tax.  The Court has essentially given the federal government a green light to use the tax code to abusively extend federal power.  All liberty loving Americans should now realize the urgency of constitutionally eliminating the income tax at both the federal and state levels.
